Invitational Hazards
Reviewing invitational hazards with your clients is a great way to learn more about their situation and set yourself up as an expert. Invitational hazards are any product or location that invites (intentionally or not) people to that attraction, which then could harm them.
Some examples include:
- Pools. We all love our pools and they often times are a necessity in the desert.
• Trampolines. These are fun to use and can be enjoyed for years when properly maintained.
• Zip lines and/or large playground equipment. Fun for kids, but often dangerous if in disrepair.
As a firefighter, I have responded to many scenes that involved the above mentioned items. Many times, the outcome was less than ideal and occasionally fatal. The problem has gotten so bad, that some insurance companies will cancel coverage or charge a super-premium just for owning these attractions. This is because the potential for an issue is extremely large and costly were an accident to occur. This leaves the property owner open to litigation. For the doubters that say friends would never sue them, or insurance would cover the cost; I implore you to imagine how good a friendship is after a life-altering accident to a child, or if homeowner insurance would truly cover the cost of such a disaster. Worst of all, these invitational hazards could be used, and accidents could happen without the homeowner’s permission to be on the property. That means the homeowner is still liable, whether or not the victim had permission to use the items, even if trespassing!
The potential for lawsuits is huge. As a Real Estate Professional, you help your clients find their dream home by learning more about their specific needs. Why not address invitational hazards as well? Or better yet, hire us to give a complete safety program on your behalf.
